The decision of whether a vocational expert will be present at your Social Security or SSDI hearing is solely the judge’s discretion. You and your attorney don’t get to decide whether a vocational expert is there or not so the answer is maybe. You will know in advance however if you’ll have a vocational expert there, generally when they’re scheduling the hearing with the attorney’s office, the attorney’s office should be asking will there be a vocational expert there and know who that vocational expert is so that we have an idea of how they’ve testified in the past. In addition to that, when you get your notice of hearing, there will be a separate page that gives you the information on the vocational expert so will know if a vocational expert is going to be present.
